What is a Dynamic Market Modification Notice?

A UK15 notice, formally a ‘Dynamic Market Modification Notice’ under section 39(4) of the Procurement Act 2023, must be published as soon as reasonably practicable after a contracting authority modifies a Dynamic Market that’s already established.

Regulation 25(6) sets out what it must contain. Importantly, the Act does not allow conditions for membership to be modified during the life of a Dynamic Market – that bar is fixed at establishment to ensure fairness to every supplier, whenever they apply. What a UK15 does cover is:

  • The date from which the modification takes effect
  • Where the list of suppliers on the market is being amended, details of any supplier being added or removed
  • A summary explaining any other modifications – sufficiently detailed for interested parties to understand the nature and scope of the change, for example the addition of a new part to the market or new specifications for goods that can be procured under it.

When are Dynamic Market Modification Notices Published?

UK15 notices are published reactively, whenever a contracting authority makes a change to an existing Dynamic Market.

  • Triggered by change, not a schedule: A UK15 appears whenever the authority adds or removes a supplier, or otherwise modifies the market’s scope.
  • Can happen more than once: A single Dynamic Market may be modified multiple times over its life – for example, as new suppliers join or new parts are added – so it’s worth checking for more than one UK15 against any market you’re monitoring.

How can Suppliers use Dynamic Market Modification Notices?
