A UK15 notice, formally a ‘Dynamic Market Modification Notice’ under section 39(4) of the Procurement Act 2023, must be published as soon as reasonably practicable after a contracting authority modifies a Dynamic Market that’s already established.
Regulation 25(6) sets out what it must contain. Importantly, the Act does not allow conditions for membership to be modified during the life of a Dynamic Market – that bar is fixed at establishment to ensure fairness to every supplier, whenever they apply. What a UK15 does cover is:
UK15 notices are published reactively, whenever a contracting authority makes a change to an existing Dynamic Market.
Modification notices are the best way to track how a Dynamic Market’s membership and scope evolve after it’s been set up.
UK15 notices exist to keep the public record of a Dynamic Market accurate and current throughout its life, not just at the point it’s first established.
A UK15 notice shows that a Dynamic Market’s membership or scope has changed since establishment – but one thing it will never show is a change to the conditions for membership, which the Act fixes for the life of the market. Suppliers who track UK15 notices can stay current on who’s on a market and what it now covers, without needing to worry about the entry bar shifting underneath them.
